SwiftSpot Renter Terms of Service

These Renter Terms of Service ("Renter Terms") govern your use of SwiftSpot's platform as a Renter. These Renter Terms supplement and are incorporated into our general Terms of Service and Privacy Policy. By booking a parking spot or storage space on SwiftSpot, you agree to comply with these Renter Terms, our general Terms of Service, and all applicable policies.

1. Acceptance of Terms

By booking or reserving a parking spot or storage space, you accept these Terms as a binding legal agreement between you and SwiftSpot. If you do not agree to these Terms, you may not use our Services.

2. Eligibility

To use SwiftSpot as a Renter, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain a valid payment method on file

3. Account Registration and Security

You must create and maintain an account with accurate, current information. You are responsible for:

  • Safeguarding your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Keeping your account information up to date

4. Booking and Use of Spaces

When you book a parking spot or storage space, you agree to:

  • Use the space only for its intended purpose (vehicle parking or item storage)
  • Use the space only during the reserved time period
  • Follow all rules and restrictions specified by the Host
  • Treat the space and surrounding property with respect
  • Comply with all applicable laws and regulations
  • Not sublease or transfer your booking to others

5. Fees and Payments

All fees must be paid through our secure payment processor, Stripe.

  • Platform Fee: A one-time 7% platform fee applies to your first booking only
  • Booking Fees: As displayed at the time of booking
  • Taxes: You are responsible for any applicable taxes
  • Payment Security: SwiftSpot does not store your full payment card details

6. Cancellations and Refunds

Our cancellation policy provides:

  • Within 5 minutes: Full refund, no questions asked
  • More than 24 hours before start: Full refund
  • Within 24 hours of start: No refund available

Special circumstances (medical emergencies, natural disasters, host cancellation) may qualify for exceptions. Contact support@swiftspot.ca with documentation.

7. Prohibited Activities

You agree not to:

  • Damage the parking spot, storage space, or surrounding property
  • Store hazardous, illegal, or prohibited items
  • Exceed the booked time without authorization
  • Park vehicles larger than the space accommodates
  • Engage in any illegal activities
  • Circumvent our payment systems
  • Harass or abuse Hosts or SwiftSpot staff

8. Insurance and Liability Disclaimers

SwiftSpot does not provide insurance coverage for:

  • Your vehicle or its contents
  • Your personal property or stored items
  • Damage caused by third parties, weather, or other events
  • Theft or vandalism

Risk Acknowledgment: By using our Services, you acknowledge that parking and storage carry inherent risks. We strongly recommend maintaining appropriate insurance coverage for your vehicle and stored items.

9. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration conducted in British Columbia, Canada. You agree to waive any right to participate in class actions or class-wide arbitration.

10. Termination

SwiftSpot may suspend or terminate your account for:

  • Violation of these Terms or our policies
  • Fraudulent or illegal activity
  • Repeated complaints from Hosts
  • Failure to pay applicable fees

You may terminate your account at any time by contacting support@swiftspot.ca.

11. Modifications to Terms

SwiftSpot may modify these Terms at any time by posting the revised Terms on our platform. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the courts of British Columbia.
