SwiftSpot Storage Host Terms

These Storage Host Terms ("Storage Host Terms") govern your use of SwiftSpot's platform for listing storage spaces. These terms supplement our general Host Terms of Service and apply specifically to storage space listings.
By listing a storage space on SwiftSpot, you acknowledge that you have read, understood, and agree to these Storage Host Terms in addition to our general Host Terms.
1. Storage Host Eligibility
To list a storage space on SwiftSpot, you must:
- Be at least 18 years of age
- Have the legal right to rent the storage space (ownership or authorization)
- Comply with all applicable zoning laws and regulations
- Ensure the space meets basic safety standards
- Not violate any lease agreements, HOA rules, or property restrictions
- Have appropriate liability insurance (strongly recommended)
2. Listing Requirements
2.1 Accurate Description
Your storage space listing must accurately describe:
- Dimensions: Accurate size in square feet or meters
- Access: How renters access the space (key, code, appointment)
- Access Hours: When renters can access their items
- Security: Locks, cameras, alarms, or other security features
- Environment: Climate control, ventilation, humidity levels
- Location Type: Garage, basement, shed, warehouse, etc.
- Permitted Items: What categories of items you allow
- Restrictions: Any items or activities not permitted
2.2 Photos
You must provide accurate, recent photos showing:
- The actual storage space being offered
- Entry points and access areas
- Any security features
- Current condition (clean and empty)
2.3 Environmental Disclosure
You must disclose if your space:
- Is NOT climate-controlled
- Has known moisture, humidity, or water intrusion issues
- Is subject to extreme temperatures
- Has had pest issues in the past
- Is in a flood zone or has flooded before
- Shares space with other renters or your personal items
3. Safety Standards
Your storage space must meet the following minimum safety standards:
Required
- Structural integrity (no risk of collapse)
- Protection from direct weather exposure
- Adequate ventilation
- Functional locking mechanism
- Safe access (no hazardous entry)
- Free from known hazards
Recommended
- Smoke/fire detection
- Security cameras (with disclosure)
- Climate control for sensitive items
- Pest prevention measures
- Lighting in access areas
- Insurance coverage
4. Prohibited Items Enforcement
4.1 Your Responsibilities
As a Storage Host, you must:
- Clearly communicate prohibited items in your listing
- Reserve the right to inspect for prohibited items
- Report suspected illegal items to appropriate authorities
- Not knowingly allow storage of prohibited items
4.2 Your Rights
You have the right to:
- Refuse any items not permitted in your listing
- Terminate rentals if prohibited items are discovered
- Enter the space to remove hazardous or illegal items
- Cooperate with law enforcement without liability
5. Liability and Insurance
5.1 Your Liability
As a Storage Host, you may be liable for damage to stored items only in cases of:
- Gross negligence: Reckless disregard for the safety of stored items
- Willful misconduct: Intentional acts causing damage
- Misrepresentation: Material false statements about storage conditions
You are NOT liable for:
- Theft or burglary (unless caused by your negligence)
- Natural disasters or force majeure events
- Damage from environmental conditions disclosed in your listing
- Damage caused by the renter's own items or negligence
- Pest damage (unless you knew of and concealed an infestation)
5.2 Insurance Recommendations
Important Insurance Notice
SwiftSpot does NOT provide insurance coverage for Storage Hosts. We strongly recommend:
- Reviewing your homeowner's or commercial property insurance
- Obtaining additional liability coverage for rental activities
- Consulting with an insurance professional about storage rental coverage
6. Access and Inspections
6.1 Renter Access
You must provide renters with access as described in your listing. Any changes to access must be communicated promptly.
6.2 Your Right to Enter
You may enter the rented storage space:
- In emergencies (fire, flood, security breach)
- For inspection with 24-hour notice (except emergencies)
- To make necessary repairs
- When required by law enforcement with proper documentation
- After termination of the rental agreement
- When payment is more than 14 days overdue
7. Abandoned Property Procedures
7.1 When Property is Abandoned
A renter's property may be considered abandoned when:
- The rental period has ended AND items remain for 30+ days
- Rent is unpaid for 30+ consecutive days after notice
- The renter provides written notice of abandonment
- The renter cannot be contacted for 60 days despite reasonable efforts
7.2 Notice Requirements
Before disposing of abandoned property, you must:
- Send written notice to the renter's email and phone on file
- Wait the required period under applicable provincial/state law
- Document all attempts to contact the renter
- Follow SwiftSpot's abandonment notification process
7.3 Disposal Process
After proper notice and waiting periods:
- Items may be sold at public or private sale
- Proceeds apply first to amounts owed to you
- Any surplus must be held for the renter or remitted according to law
- Items with no resale value may be donated or disposed of
- Document the entire process for your records
8. Lien Rights
Depending on your jurisdiction, you may have a lien on stored property for:
- Unpaid rent and fees
- Damages to your property caused by stored items
- Costs of enforcing the rental agreement
Lien rights vary by province/state. Consult with a legal professional to understand your rights and obligations.
9. Cancellation by Host
9.1 General Rule
Once a storage booking is confirmed and paid, you cannot cancel it directly. This protects renters who have planned their storage needs around your availability.
9.2 Exceptions
You may request cancellation through SwiftSpot support if:
- The booking start date is more than 2 weeks away
- You have a documented emergency
- The renter has violated terms (e.g., prohibited items)
- Safety concerns require immediate termination
Repeated cancellations may result in account penalties or suspension.
10. Privacy and Surveillance
10.1 Surveillance Disclosure
If you have surveillance cameras or monitoring:
- You MUST disclose this in your listing
- Cameras must NOT be inside the storage space itself
- Common areas and entry points may be monitored if disclosed
- You must comply with all privacy laws regarding surveillance
10.2 Renter Privacy
You must respect renter privacy:
- Do not share renter information with third parties
- Do not photograph or inventory renter's belongings
- Provide access only to authorized persons
11. Tax Responsibilities
As a Storage Host, you are responsible for:
- Reporting all rental income to tax authorities
- Collecting and remitting applicable sales taxes (if required)
- Maintaining records for tax purposes
- Understanding your local tax obligations for rental income
SwiftSpot may provide annual earnings statements but does not provide tax advice.
