SwiftSpot Storage Terms of Service

These Storage Terms of Service ("Storage Terms") govern your use of SwiftSpot's platform for renting storage spaces. These Storage Terms supplement our general Terms of Service and Privacy Policy. By booking a storage space on SwiftSpot, you agree to these Storage Terms in addition to our general Terms.
Important Notice
SwiftSpot does NOT provide insurance for stored items. You are solely responsible for insuring your property. Please read these terms carefully before booking.
1. Eligibility and Acceptance
To use SwiftSpot storage services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate identification and contact information
- Maintain a valid payment method on file
- Accept full responsibility for all items you store
2. Nature of the Storage Relationship
2.1 No Bailment
The storage space rental creates a landlord-tenant relationship for the space only, NOT a bailment. This means:
- SwiftSpot and the Host do NOT take possession, custody, or control of your stored items
- Neither SwiftSpot nor the Host has a duty to care for, protect, or safeguard your stored items
- You retain exclusive possession and control of the items you store
- The Host provides space only; they are not a warehouseman or bailee
2.2 Platform Role
SwiftSpot acts solely as a marketplace connecting storage space Hosts with Renters. SwiftSpot is not a party to the storage agreement between you and the Host and has no liability for your stored items.
3. Prohibited Items
You may NOT store the following items in any SwiftSpot storage space. Violation may result in immediate termination, removal of items, and/or legal action:
Hazardous Materials
- Explosives, fireworks, ammunition
- Flammable liquids (gasoline, propane, etc.)
- Toxic or radioactive materials
- Corrosive substances (acids, batteries)
- Compressed gases
Illegal Items
- Controlled substances or drug paraphernalia
- Stolen property
- Counterfeit goods
- Illegal weapons
- Items used in illegal activities
Perishables & Living Things
- Food items (unless specifically approved)
- Plants or seeds
- Animals, insects, or living organisms
- Items that may rot, decay, or attract pests
High-Risk Items
- Cash, currency, or bearer instruments
- Jewelry or precious metals over $5,000
- Irreplaceable items (family heirlooms, one-of-a-kind art)
- Items requiring climate control (unless space is climate-controlled)
Note: Legal firearms may be stored only if compliant with all applicable federal, provincial/state, and local laws, and only with Host's explicit written permission.
4. Value Limitations and Declarations
4.1 Maximum Value
Unless you obtain express written agreement from the Host and SwiftSpot:
- The maximum aggregate value of items you may store is $5,000 CAD
- Any claim for loss or damage is limited to this amount regardless of actual value
- Items exceeding this value must be declared and may require additional insurance
4.2 Value Declaration
By storing items, you represent that:
- The total value of stored items does not exceed the maximum limit unless disclosed
- You have made your own arrangements to insure items of significant value
- You accept liability for any loss exceeding the maximum value limit
5. Insurance Requirements
Insurance Disclaimer
SwiftSpot does NOT provide any insurance coverage for your stored items.
Neither SwiftSpot nor the Host maintains insurance that covers your personal property. You are solely responsible for obtaining adequate insurance coverage.
We strongly recommend:
- Checking if your homeowner's or renter's insurance covers off-site storage
- Purchasing dedicated storage insurance if your existing policy does not provide coverage
- Documenting and photographing items before storing
- Keeping an inventory list with estimated values
6. Liability Limitations
6.1 No Liability for Loss or Damage
To the maximum extent permitted by law, neither SwiftSpot nor the Host shall be liable for any loss, damage, or destruction of stored items arising from:
- Theft, burglary, or vandalism
- Fire, flood, water damage, or natural disasters
- Mold, mildew, rust, corrosion, or environmental conditions
- Pest infestation (rodents, insects, etc.)
- Actions of third parties
- Power failures affecting climate control
- Acts of God or force majeure events
- Your own negligence or failure to properly secure items
6.2 Host Liability Exception
Hosts may only be liable for damage to stored items in cases of:
- Gross negligence directly causing damage
- Willful misconduct
- Material misrepresentation of storage conditions in the listing
In such cases, liability is limited to the lesser of: (a) the actual cash value of damaged items, (b) the cost of repair, or (c) $5,000 CAD.
6.3 Your Liability
You are liable for:
- Any damage your stored items cause to the storage space or property
- Cleanup costs for spills, leaks, or contamination from your items
- Pest remediation if your items introduce pests
- Any fines or penalties resulting from prohibited items
7. Access Rights
7.1 Your Access
Your access to the storage space is governed by:
- The access hours and terms specified in the listing
- Any access codes or keys provided by the Host
- Advance notice requirements set by the Host
7.2 Host Access Rights
The Host reserves the right to enter the storage space:
- In case of emergency (fire, flood, security breach)
- To inspect for prohibited items with reasonable notice
- To make necessary repairs or maintenance
- If required by law enforcement with proper documentation
- Upon termination of the rental agreement
- If payment is more than 14 days overdue
8. Late Payment and Lien Rights
8.1 Payment Obligations
You agree to pay all fees when due. Late payments may result in:
- Denial of access to the storage space
- Late fees as specified in the booking
- Termination of the rental agreement
8.2 Lien on Stored Items
To the extent permitted by applicable law, the Host may have a lien on your stored property for:
- Unpaid rent and fees
- Damages caused by your stored items
- Costs of enforcing the rental agreement
This means the Host may retain possession of your items until all amounts owed are paid in full.
9. Abandonment of Property
9.1 Abandonment Definition
Your stored items may be considered abandoned if:
- Your booking has ended AND you fail to remove items within 30 days
- You fail to pay rent for 30 consecutive days after notice
- You provide written notice of abandonment
- You cannot be contacted after reasonable efforts for 60 days
9.2 Notice Requirements
Before treating items as abandoned, we will attempt to notify you:
- Via email to your registered email address
- Via SMS to your registered phone number
- Via certified mail to your last known address (if available)
9.3 Disposal of Abandoned Items
After items are deemed abandoned and required notice periods have passed:
- Items may be sold at public or private sale
- Proceeds will first be applied to amounts owed
- Any surplus will be held for you for 90 days, then forfeited
- Items with no resale value may be donated or disposed of
- You remain liable for any deficiency after sale
10. Environmental Conditions
10.1 No Climate Control Guarantee
Unless the listing specifically states the space is climate-controlled:
- Temperature and humidity are NOT controlled
- Items sensitive to temperature, humidity, or moisture should not be stored
- You assume all risk of damage from environmental conditions
10.2 Your Acknowledgment
You acknowledge and accept that storage spaces may be subject to:
- Temperature fluctuations
- Humidity variations
- Dust and particulates
- Condensation
- Natural settling and vibration
11. Termination
11.1 Termination by You
You may terminate your storage rental at any time by:
- Removing all your items from the storage space
- Returning any keys or access devices
- Notifying the Host of your departure
Refunds are subject to our standard Cancellation Policy.
11.2 Termination by Host or SwiftSpot
We may terminate your storage rental immediately if you:
- Store prohibited items
- Fail to pay rent when due
- Violate these Storage Terms
- Engage in illegal activities
- Create a nuisance or safety hazard
12. Dispute Resolution
Any disputes arising from storage rentals shall be resolved according to the dispute resolution procedures in our general Terms of Service, including binding arbitration in British Columbia, Canada.
